Employment Practices Liability Insurance
THE POLICY
Our Employment Practices Liability policy covers the organisation as well as past and present Directors and Officers, and all employees for the following.
- Wrongful refusal to employ an applicant for employment.
- Wrongful failure to promote an employee.
- Wrongful demotion, negligent evaluation, negligent reassignment or disciplinary action.
- Wrongful termination of employment, including constructive dismissal.
- Sexual harassment.
- Unlawful discrimination which may include discrimination on the grounds of race, colour, sex, sexual preference, age, physical or mental status, family responsibilities, pregnancy, religion, political opinion, national extraction or social origin.
- Oral or written publication of material that slanders, defames or libels an Employee or violates or invades an Employee's right of privacy.
The term wrongful is defined in the policy as meaning unfair or unlawful.
WHO NEEDS THIS COVER?
All Catholic employers with an exposure to claims arising from wrongful employment practices.
DEDUCTIBLES/EXCESS
A $500 deductible/excess is applicable to all claims made under the policy.
LIMITS OF LIABILITY
The minimum limit of indemnity for this product is $1,000,000 (including defence costs).
STAMP DUTY
Where applicable stamp duty is added to the premium.
FEATURES and BENEFITS
There is a coinsurance participation for the Employment Practices Liability policy which means that for every claim in which damages are paid the Insured contributes to the sum which is paid. The coinsurance participation is 5% of damages for each and every claim limited to a maximum of $25,000 per claim. It is important to note that the coinsurance participation does not apply to defence costs.
IMPORTANT POINTS
As with other classes of insurance it is a condition of the policy that the Insured shall not admit any employment practice.
This is a claims made policy meaning that the claim must have first been made against the Insured during the period of insurance and notified to us during that period of insurance. It does not matter when the incident giving rise to the claim happened, provided the incident occurred after the original inception of the policy.
TAKING OUT A POLICY
Catholic Church Insurances Limited will assist in obtaining information necessary for providing a quotation or issuing a policy.
If a claim is made against you, we must be notified as soon as possible and you will need to provide us with copies of documents in connection with the claim. Due to the nature of these types of claims, it is important that prompt notification is given to enable investigations to be made and if necessary to commence a mediation process or alternatively defend the claim if this considered appropriate.
